well this pass @ the track, it says not legal for competition? its for my little street car running 11.4s now but going for high 10s

NO! It needs back bars and diags behind the seats. And the door bar should cross between the shoulder and elbow with driver seated.

We have couple of low 10 second cars with them so probably depends on track

By the rules no.

But, I have seen several low 10 second cars running with stuff like that at the old Gateway.

Now would I do it? NO

I guess it really depends on how low that drop down really is. If the bar is at or above your elbow when you're in the seat then you're good. NHRA rules say the bar must pass between your elbow and your shoulder. I have done a few for streetcars like that..
