Well you know things are going bad when I come to the bullet for legal advice lol. This isn't for me, but my mom. I have an idea on how to get her stuff from her ex, but it will end up with him taking a long nap waking up in hospital and me having some court dates :)

Anyhow, they went to court and she was given court papers signed by the judge to get her personal belongings. So last Saturday we got the truck ready and headed out. On our way we called the local police department to meet us there. The cops said this wasn't something they could handle, they only have the ability to stay for 10 minutes or so. They referred us to contact the sheriff's department who has a team dedicated to this sort of thing. That was understandable, but the cops showed up and knocked on the door etc. Her ex opened the garage and had about 6 boxes packed that were her belongings. He let her in the house but wouldn't let her take anything. Several items were hers before they were even married and the refridgerator is MINE! So, my mom is upset and crying, I'm about to flip my lid so I talked with the cops and said we would just contact the sheriff's department and left.

We called the sheriff's department yesterday and they said that's out of their jurisdiction and to call the local police department. So, here we are back at square one. She called her lawyer back and the lawyer said to just go in the house and start taking her stuff, lol. Yea, that's a great idea, she will end up getting more business when her husband puts a finger on my mother. So, besides her husband, IMO being in contempt of court for not following the court order, any suggestions from you guy's?

Sorry for the long, WAY OT post, but sometimes you crazy bastards have some good input!

what she can do depends on what state your in and the laws there---learned this the hard way from my first marriage-- we decided we were done and she left at night so i went and got new locks for the doors because i knew she would try to come and take shit while i was at work the next day. Well i was right she came to get her stuff and she and whoever was with her kicked the door in and cleaned the fucking house completely out,all my clothes and personal shit included.When i called to report it they said its a civil matter and she had every right to be there since we were married.

I am with CharlieP on this one.... except the 50 dollar fridge comment.... them bitches are like 1500 bucks. But anyway, the point is simply this:

Screw the fridge, take it as a lesson learned. As long as your mom got her prized possessions back, then leave the fridge and be done with this loser. It will cost you SOOOOO much more in attorney's fees and your own personal time if you lose your temper or even just trying to do the right thing by taking him back to court. Remember the only true winners in a court room are the attorney's.... they get paid whether you win or lose.

This is the reason so many people will decide to (when they leave their companion) clean the house out before filing any papers. Much easier to give back than take.

Some people crack me up. It's not only a refridgerator dude, which btw was $1400 and 2 years old. It's all my moms things, curio cabinet, couches, family pictures. Yeah, just give it all to the guy because he is a turd.

Now you didn't state this in the original post. In that case, take a day off and watch his house. He's gotta leave sometime and when he does, clean that bitch out. If the cops come over, tell them this is all your mothers belongings that the judge ordered her to have and tell the cops he let take them. Cops will defer to a civil matter. Case closed.

was there a list of stuff spelled out she could have, or does it just state "her stuff"-sounds like he is bitter about the breakup, reason he is like he is
tough call, we all know what we would like to do, lol, but diff states and diff laws-if the courts did spell out items she (and you) were entitled to, then i would think someone in the court system, police, whoever should be able to assist, or be assigned by the judge to

Theres only two ways that this can be handled. You let the attorneys get your stuff back for you which means more court, time and more money to the lawyer (probably much more than the stuff is worth in terms of money) or go all Chuck Norris and kick his ass and take the stuff. If you take route #2 you will go to jail, possibly get hurt and still wind up paying the lawyers. Basically what I'm saying is you are probably SOL unless the guy voluntarily decides to give you the stuff back.

Thanks for the replies gents. I don't mean to come off the wrong way, I know when you say forget about it, it's only because you've probably been through it before and realized what a PITA it can be.

You're exactly right in saying he's a control freak. He let my mom in the house with a police escort and she wanted to take her curio cabinet and all her precious moments my brother and I bought her over the years, with a smug look on his face he looked at her and said, NO. It's obvious some of these items are clearly hers.

That's the problem, none of this was spelled out in court with a list of items. It was a blanket statement that said, personal belongings. In his opinion, personal belongings are her clothes I suppose.

If I don't end up strangling this guy i'll be luck.
