Greg Haidl takes case to state Supreme Court

Greg Haidl and two other men convicted in a high-profile sexual assault case no longer want to be registered sex offenders, and are taking their case to the state Supreme Court.
Haidl, 24, Keith Spann and Kyle Nachreiner, both 25, filed petitions this week asking the court to review a lower appeal panel's decision that upheld their March 2005 conviction in Orange County Superior Court.

The three men were the center of media attention for several years due to a July 5, 2002, sexual encounter captured on videotape. It was filmed at the Corona del Mar house of Haidl's father, then-Assistant Sheriff Don Haidl.
The videotape shows the men, who were juveniles at the time, laughing and engaging in group sex with the then-16-year-old Jane Doe, who appears to be unconscious. They also insert foreign objects into Jane Doe, including a pool cue, a Snapple bottle and a lit cigarette.
The trio were each convicted, after a re-trial, of multiple counts of sexual penetration with a foreign object by intoxication. Each was sentenced to six years in prison. They also were ordered to register as lifelong sex offenders.
They appealed to the 4th District Court of Appeal in Santa Ana, which affirmed the men's conviction and sex offender status in March.
In a petition filed this week, Haidl's attorney, Dennis Fischer, argued that the men should not have to register as sex offenders because they were acquitted of the one charge that allowed prosecutors to try them as adults (felony assault with force that resulted in great bodily injuries).
If they were tried as juveniles, the men would not be labeled lifelong offenders for the particular sex offenses they were convicted of, he added.
"There should be some mechanism in the law after a period of good behavior and rehabilitation to petition a court to relieve them of the hardship of registration,'' Fischer said Thursday.
In its opinion, the appeals court addressed the issue and upheld the men's status, citing a hearing given by the state court judge that found the trio unfit to be tried as juveniles.
Susan Kang Schroeder, chief of staff for Orange County District Attorney Tony Rackauckas, was dismissive of the men's appeal.
"Men who prey on helpless women who are too intoxicated to say no are sexual predators. The public has a right to know who they are and what they've done and where they live,'' she said. "Again, the Haidl three always want to have preferential treatment. That's what makes them dangerous."
The men also appealed on other grounds, including questioning the trial court's exclusion of testimony about a prior sexual experience of Jane Doe. The court will decide within 90 days if it will consider the case.
