Default Class 3 license and full autos

can anyone educate me about the laws concerning full auto guns?

I've been told all you need do is get a Class 3 license and you're ok.?????

It is NOT a license ... the firearms / devices are " Class 3 and you will fill out a form # 4 and have it signed by either the top law dog in your county or the D.A.

As long as Class 3's are allowed in your state, county, city and you can legally purchase / own a firearm then you can buy a class 3.

You pay a 200 $ " tax " on each device ...

I got into a debate at work last week with 3 guys that were telling me that a license was needed and you even had to pay the 200 $ annually ... this was after I told them I owned one. And they still didnt get it ....

The problem isnt normally the formailities,its finding a weapon thats tranferable and a dealer willing to transfer it.

It is a federal licence investigated and issued by the ATF, it is not issued by a local entity since it is federally controlled. Go to the ATF website and ask or call people that know the laws, It's a hell of alot better than getting false info that can land your ass in trouble. How is it a " License " ?

It is a piece of papaer that basically follows the " device ". You get a differant " form # 4 " which each " device " and it stays with that device.

Once I sell mine, I have to get another form filled out, pay the 200 $ tax. I can NOT simply go out and buy another because I have a " License " for the one I own now.

You send the form and the 200 $ to a Dept. of the Treasury in Illinois, they cash the check right away and sit on the paperwork for a weeks and then send it off to the FBI in Quaintico Va. where they sit on it for a few weeks / months and then sign / stamp it and send it back to the seller who then contacts you and pick up arrangements are made ... NOTE ... That is for an In - State transfer. At least thats how mine and everyone else I know around here has had it happen.


Out of State transfers are a PIA and require multiple transfers. But still not impossible

It looks like changes have been made since I purchased mine, instead of sending the form to the treasury you send it to the ATF now. Same signature needed from " Cheif Law Offical in jurisdiction ". Form is slightly differant, but all the same info is required. Nothing new.

Everything else applies. In short ... fill out a form # 4, send it and 200 $ in and then wait.

It is a ATF form with a tax stamp on it. You can buy a DEWAT and activate it also. Only papered weapons are available to the general public, if they can't show you the paper with the stamp, walk away.

correct. it is a tax stamp. it cost 200 per weapon..to do the transfer to you. the only full auto's that can be legaly transfered to the public we MADE AND SOLD to the public prior to the 1986 machine gun ban. any full auto made or transfered after 1986 can only go to class 2 manufactures or class three 3 dealers as samples...that is why they are so exspensive. even a cheap mac 10 will cost 3k and an usi goes for 8k now..silencers are still cheap because they can still make them..

as for me i go to the range and shoot there full auto's cost 20 and you can have all the fun you can afford to( ammo is not cheap).
if you do decied to buy a full auto do your homework first. they are many differnt ways to get one. on some it is the reciever that is regestierd and some it is the sear(part that makes it full auto)
it is better to buy one where it is the sear that is regestierd so when you ware the gun out you can stick the sear into a new host gun. but if you buy one that is a receiver gun if you wear it out it needs to be repaired or your 10k investment is gone..and the sears can be regestered in many calibers so you can change host guns..but be carefull in that because if you have more than one host gun if the barrel is shorter than 16inches once you take the sear out to change guns you now have an illegal short barrel riffle..there are so many laws with nfa stuff you really need to do all your homework first to keep yourself out of trouble..

They have machine gun day at the local range once in awhile, the guy who owns it has a large collection of nice stuff. $15 and pay for ammo and you can shoot his weapons, it is a ton of ton and nice of him to give us the oppurtunity.

alot of ranges here have full auto stuff because they are class three dealers. they can buy what is called a post dealer sample. they are same price as semi auto. an mp5 post sample goes for about 1500. so they can rent them all day long and still make money. but since they are post(after 86 ) samples if the shop closes they must destroy them...
